Terms of Use

Effective October 15, 2026.

These Terms of Use ("Terms") govern your use of Wayvilo at wayvilo.com (the "Service"). Wayvilo is operated by Westen Miller, an individual based in Pennsylvania ("Wayvilo," "we," "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Wayvilo.

1. What Wayvilo is

Wayvilo is a free tool for discovering vacation rentals, comparing booking options, and planning trips with others. Wayvilo is not a travel agency, booking agent, or real estate broker, and it is not a party to any rental agreement. We do not own, manage, inspect, or rent any property, and we do not take reservations or payments.

2. Eligibility and accounts

You must be at least 18 years old to create an account. Give accurate information, keep your password secure, and tell us at admin@wayvilo.com if you believe someone has accessed your account without permission. You are responsible for activity under your account.

3. Listings, prices and comparisons

Listing details, photos, prices, and fees come from rental companies and property owners. Prices are entered manually and are not live rates. Estimated stay totals, comparison prices, and savings labels such as "cheaper booking direct" are estimates based on information supplied to us and may be outdated or incomplete. Approving a listing is not an inspection or endorsement of the property or the company.

Before booking, confirm availability, the final price, taxes, fees, cancellation terms, and house rules directly with the booking provider. We are not responsible for differences between information on Wayvilo and what a provider offers you.

4. Booking with third parties

When you follow a booking link, you leave Wayvilo. Your reservation, payment, cancellation, refund, and any dispute about the stay are between you and the provider, under its terms. Wayvilo is not responsible for the condition, safety, legality, or availability of any property, or for the conduct of any host, rental company, or other user.

5. Plans, sharing and expenses

A plan is a shared notebook. Creating a plan, voting, or adding a home does not reserve anything. Expense balances and reimbursements are notes only; Wayvilo does not handle, verify, or guarantee payments between members. Anyone with an invitation or comparison link may be able to view or join, so share links only with people you trust.

6. Your content

"Your content" means anything you post or upload, including photos, comments, messages, profile details, travel tips, and listing information. You keep ownership of your content.

You give Wayvilo a non-exclusive, worldwide, royalty-free license to host, store, copy, display, resize, and format your content to operate and display the Service, consistent with your privacy settings. This license ends when you delete the content or your account, except for copies already shared with members of a plan or kept where the law requires.

You confirm that you have the right to post your content, that it does not violate anyone's rights or the law, and that people shown in your photos are comfortable with you sharing them.

7. Rules

Do not:

• Post content that is illegal, harassing, hateful, sexually explicit, or invades someone's privacy.
• Publicly post entry codes, lockbox codes, receipts, or other people's personal information.
• Impersonate anyone or misrepresent your connection to a property or company.
• Submit false, misleading, or intentionally understated listings or prices.
• Upload malware, scrape or harvest data, or interfere with the Service or its security.
• Send spam or unsolicited advertising through Wayvilo.
• Use the Service in any way that breaks the law.

We may remove content and suspend or close accounts that break these rules or that we believe put users or Wayvilo at risk.

8. Rental companies

Rental companies and owners who list properties also agree to our Listing Terms.

9. Copyright

We respond to notices of copyright infringement as described in our Copyright Policy, and we close the accounts of repeat infringers in appropriate circumstances.

10. Feedback

If you send us ideas or suggestions, we may use them without any obligation to you.

11. Disclaimer

Wayvilo is a free, personal project provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be available, secure, or error-free, or that any listing, price, or savings figure is accurate.

12. Limitation of liability

To the fullest extent permitted by law, Wayvilo and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, booking costs, or travel expenses, arising from your use of the Service, any listing, or any stay, even if advised of the possibility. Our total liability for any claim related to the Service is limited to $100. Some places do not allow these limits, so they may not apply to you.

13. Indemnity

You agree to defend and hold harmless Wayvilo and its operator from any claims, losses, and expenses, including reasonable attorneys' fees, arising from your content, your use of the Service, your listing or stay, or your violation of these Terms or anyone's rights.

14. Ending your use

You can request account deletion at any time through our contact form or by emailing admin@wayvilo.com. We may suspend or end your access, or change or discontinue any part of the Service, at any time. Sections 3, 4, 6, 11, 12, 13, and 15 continue to apply after your use ends.

15. Disputes and governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Allegheny County, Pennsylvania, and you consent to their jurisdiction. Either of us may bring a qualifying claim in small claims court. Before filing anything, please contact admin@wayvilo.com so we can try to resolve it informally.

16. Changes to these Terms

When we update these Terms, we will change the effective date. For material changes, we will notify you by email or on the site before they take effect. Using Wayvilo after changes take effect means you accept them.

17. General

If any part of these Terms is unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver of it. You may not transfer these Terms; we may transfer them along with the Service. These Terms, the Listing Terms (if you list properties), and the Privacy Policy are the entire agreement between you and Wayvilo about the Service.
